We respect the creativity and hard work of others. Our platform is a place where everyone can enjoy great recipes, share their love for food, and connect over shared experiences. Just like any space, we also need to ensure that everyone’s intellectual property is treated with the same respect. This DMCA policy is designed to outline the steps for addressing any content issues related to copyright infringement.
Our Commitment
We take copyright infringement seriously. We’re committed to complying with copyright laws and will always take prompt action if we receive valid claims. If you believe your intellectual property rights have been violated, please let us know. We’re here to resolve any concerns you may have, ensuring both creators and visitors are protected.
How to Submit a Claim
If you feel your copyrighted material has been used without permission on Tim's Kitchen, we encourage you to file a formal Digital Millennium Copyright Act (DMCA) takedown notice. To submit your claim, simply send the following information to our designated DMCA agent at dmca@timskitchen.com.hk:
- Your contact details: This includes your full name, physical address, email address, and telephone number.
- Identification of the copyrighted work: Describe the work(s) you claim to be infringed. Be as specific as possible, including URLs where the content is located on Tim’s Kitchen.
- Description of the infringement: Let us know why you believe the content is infringing upon your rights. Please provide details on how you believe the material violates your copyright.
- Location of the infringing content: Provide the exact URL(s) where the allegedly infringing material can be found on Tim's Kitchen.
- Statement of good faith: Confirm that you believe the use of the material in question is not authorized by the copyright owner or their agent or the law.
- Signature: Your physical or electronic signature confirming that the information you provided is true and accurate to the best of your knowledge.
Our Response Process
Once we receive your DMCA notice, we’ll review it thoroughly. If the claim is valid, we will take action to remove or disable access to the infringing content as quickly as possible. If we need more information from you, we will contact you to clarify the details. After the content is removed, we will notify the party who posted it, allowing them the chance to respond.
If the alleged infringing party believes they have the right to use the material in question, they can file a counter-notice. This counter-notice must include specific information outlined in the DMCA guidelines. If a valid counter-notice is filed, we may restore the content in question unless we receive a court order instructing us not to.
Counter-Notice Procedure
If you’ve posted content that was removed based on a DMCA takedown notice and believe the removal was a mistake or your material was used appropriately, you have the right to submit a counter-notice. You can do this by sending the following information to dmca@timskitchen.com.hk:
- Your contact details: Name, address, and email address.
- Description of the removed content: Provide specific details about the material that was removed, including URLs or other identifying information.
- Statement of good faith: Confirm that you believe the material was removed due to a mistake or misidentification, and that you have the right to use it.
- Your signature: Your physical or electronic signature.
- Agreement to jurisdiction: Agree that you will accept the jurisdiction of the court located where Tim’s Kitchen is based.
Once a valid counter-notice is received, we’ll notify the party who filed the original DMCA claim. If no further action is taken within 10-14 days, the content will be restored.
Repeat Infringer Policy
Tim’s Kitchen reserves the right to terminate the accounts of users who are found to be repeat infringers. We encourage all of our users to respect copyright laws and to use only content they have permission to use.
Fair Use Disclaimer
Not all uses of copyrighted content are infringing. Under the concept of “fair use,” certain uses of copyrighted works may be permissible without permission from the copyright holder. Fair use allows for the use of copyrighted materials for purposes such as criticism, commentary, news reporting, teaching, scholarship, and research. If you believe your content falls under fair use, feel free to reach out to us.
User Responsibility
We strongly encourage all users of Tim’s Kitchen to be mindful of copyright laws. Please do not upload or share content you don’t have the right to use. Sharing content without proper authorization is illegal, and we want to maintain a space that honors creativity and originality.
Content Removal
In cases of copyright infringement, we will promptly remove or disable access to the material. In situations where a claim is found to be invalid, the content may be restored. We work to ensure that all parties are given fair consideration during this process.
